Tophhie Cloud Personal Data Server - Terms of Service

Service: Tophhie Cloud Personal Data Server ("PDS") for atproto/Bluesky repositories

These Terms govern your use of the Tophhie Cloud Personal Data Server (PDS), which hosts your atproto (Bluesky) repository and makes it available across the atproto network. By using the PDS, you agree to these Terms.
1) Who we are & what this covers
The Tophhie Cloud PDS runs your atproto repository so you can use Bluesky or other atproto apps. We are not Bluesky Social and we do not control other atproto services (“Developer Applications”). When your content is public, it can be fetched by other services on the network by design. Complete deletion across the wider network may not always be technically possible - this is inherent to the protocol and federation model.
2) Accepting these Terms
By creating or connecting a repo to the PDS, you accept these Terms. If you don’t agree, don’t use the service.
3) Eligibility & age
You must be 13+ (and old enough to enter a binding agreement where you live) to use the PDS.
4) Your Account & Responsibilities
- You’re responsible for actions taken using your credentials.
- Keep credentials secure; notify us promptly of any compromise.
- If you use PDS for an organisation, you confirm you have authority to do so.
5) Your Repository & Content
5.1 Ownership
You own your content and repository data.
5.2 Our limit license to operate the service
You grant Tophhie Cloud a limited, worldwide, non‑exclusive, royalty‑free licence to store, host, reproduce, transmit, and display your repository records and media only as necessary to operate, secure, back up, and deliver the PDS and atproto interoperability you request. We do not sell your content.
5.3 Federation & Deletion Limits
When you publish public records, the protocol enables other atproto services to fetch and cache them. If you delete content or your account, we will remove it from active service and notify the network as appropriate; however, we cannot force independent services to delete their copies.
6) Acceptable Use
You agree not to:
- Break the law or others’ rights, upload malware, or attempt unauthorised access.
- Harass, abuse, or harm others, or post illegal content.
- Interfere with the service’s security or integrity.
We may remove content or restrict access to protect users and the service.
7) Moderation, Reports & Appeals
- You can report issues via our support channels; we may take action consistent with these Terms and applicable law.
- If we suspend or restrict your account/repo, you may contact us to request a review, providing relevant details.
8) Service Plan, Changes & Updates
- Features and technical limits may evolve. If we make material changes that negatively affect you, we’ll provide reasonable notice where possible.
- If any fees are introduced in the future, terms and pricing will be communicated in advance (no surprises).
9) Availability & Support
We aim for a reliable service but downtime and maintenance will occur. Daily encrypted backups help with disaster recovery but may not capture every last millisecond of changes. (Backups are daily; see Privacy Policy for retention.)
Data is hosted in Microsoft Azure UK regions, with daily backups; we do not use your data for unrelated purposes or sell it. (See Privacy Policy for details.)

10) Privacy & Data Protection
Your personal data is handled per the Tophhie Cloud PDS Privacy Policy (purpose‑limited processing for atproto access, Azure UK storage, daily backups, no third‑party transfers) and your rights are as set out in our privacy materials (access, rectification, erasure, portability, etc.). Contact privacy@tophhie.cloud to exercise rights.
11) Third-party Services & Developers
You may use other atproto apps/services with your repo. Those services have their own terms and privacy practices, and Tophhie Cloud isn’t responsible for them.
12) Intellectual Property (Ours)
The PDS software, design, and branding are owned by or licensed to Tophhie Cloud. You may not copy, modify, reverse‑engineer, or misuse our IP.
13) Suspension & Termination
We may suspend or terminate your access if you violate these Terms, threaten the security or availability of the service, or where required by law. You may stop using the PDS at any time; request export or deletion as described in the Privacy Policy.
14) Warranties & Disclaimers
The PDS is provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non‑infringement.
15) Limitation of Liability
To the extent permitted by law, Tophhie Cloud will not be liable for indirect or consequential damages, loss of profits, or data loss. Our total aggregate liability arising out of or relating to the PDS will be capped at the greater of £100 or the amount you paid (if any) in the 12 months prior to the claim.
16) Indemnity
You agree to indemnify and hold Tophhie Cloud harmless from claims arising out of your use of the PDS or violation of these Terms, except to the extent caused by our breach.
17) Changes to these Terms
We may update these Terms from time to time. If changes are material, we’ll provide notice (e.g., email or in‑service notice) before they take effect. Continued use after the effective date constitutes acceptance.
18) Governing Law & Venue
These Terms are governed by the laws of England and Wales. Courts in England and Wales have exclusive jurisdiction.
